1. About these terms

These Terms of Service ("Terms") govern your access to and use of nextnest.vacations and the related free property assessment service operated by NextNest Residences ("NextNest", "we", "us"). By accessing the site or submitting an assessment, you agree to these Terms.

If you become a NextNest co-hosting client, that relationship is governed by a separate written Co-Hosting Agreement, which takes precedence over these Terms for all matters relating to the management of your property.

2. What we offer here

This website lets you request a free, no-obligation revenue assessment for short-term rental potential at a Toronto property you own, lease, or manage. The assessment includes estimated nightly rates, occupancy projections, seasonal breakdowns, and a fit check against our service.

Important

Revenue estimates shown on the assessment result pages are projections based on Toronto market data and our portfolio performance. They are not guarantees of future income. Actual earnings depend on listing quality, dynamic pricing, seasonality, guest demand, regulation changes, your availability, and many factors outside any party's control.

You should not make financial decisions (mortgage, renovation, employment) based solely on the assessment. We recommend independent verification with a financial advisor before committing capital based on projected STR income.

NextNest is not your property manager, real estate agent, lawyer, accountant, or financial advisor. If you proceed past the assessment stage, the co-hosting service is governed by our written Co-Hosting Agreement, which sets out:

No co-hosting relationship is created by submitting the free assessment, completing the onboarding form, or by any communication on this site. The Co-Hosting Agreement is the only document that creates a service relationship between you and NextNest.

7. Promotional offers

Limited-time promotional offers (such as the City of Toronto STR licence fee being covered by NextNest) are conditional on a signed Co-Hosting Agreement by the stated deadline. Offers are at NextNest's discretion, may be modified or withdrawn, and apply only to qualifying properties as determined by NextNest.

8. Intellectual property

All content on nextnest.vacations — including text, images, design, and code — is the property of NextNest Residences or its licensors and is protected by Canadian and international copyright law. You may not reproduce, modify, distribute, or create derivative works without prior written permission.

9. Third-party links and services

This site links to and integrates with third-party services (Google Calendar, Notion, Airbnb, PriceLabs, Hospitable, Turno, and others). NextNest is not responsible for the content, terms, or privacy practices of those third parties. Your use of those services is subject to their own terms.

10. Disclaimer of warranties

The site and the assessment are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, or non-infringement. NextNest does not warrant that the site will be uninterrupted, error-free, or secure.

11. Limitation of liability

To the maximum extent permitted by Ontario law, NextNest, its directors, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of this site or reliance on the assessment. Our total liability for any claim arising from your use of the site (separate from any signed Co-Hosting Agreement) is limited to one hundred Canadian dollars (CAD $100).

12. Indemnification

You agree to indemnify and hold NextNest harmless from any claim, loss, or expense arising from your breach of these Terms, your misrepresentation of property ownership or permission, or your violation of any applicable law.

13. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute will be resolved in the courts of Ontario, and you consent to the personal jurisdiction of those courts.

14. Changes to these terms

We may revise these Terms at any time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated via email to active and prospective hosts. Your continued use of the site after changes are posted constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
